All sales are final if the purchaser is responsible for the installation of the system. Return of equipment policy on all other sales is determined by individual circumstances.

Limited warranty covers workmanship and material, not including labor nor a maximum / minimum percentile of performance.

The buyer assumes all responsibility for right and proper installation pursuant to building codes, the selection of products purchased from the seller, and the fitness of such products for the buyer’s application.

Exclusive Jurisdiction

The Parties agree that any dispute, controversy or claim arising under or in connection with this agreement or its performance by either party shall be decided exclusively by and in the state or federal courts sitting in the County of Lee, State of Florida. For such purpose, each party hereby submits to the personal jurisdiction of the state and federal courts sitting in the County of Lee, State of Florida. Each party hereby agrees to and does hereby waive any right to assert or move for transfer of venue to any court outside of the State of Florida, based upon the doctrine of forum non conveniens or otherwise. Each party further acknowledges and agrees that this paragraph has been negotiated at arms’ length and that it is a knowing and voluntary agreement.
